Say you find a prostitute on Craigslist, like what you see, and pay her $150 to come over. Then, say she refuses to have sex with you and won’t give you the money back.
According to a Bexar County jury, it’s ok if you shoot and kill that woman.
Yesterday a jury of your peers acquitted Ezekiel Gilbert of murder in the death of 23-year-old Lenora Ivie Frago. If convicted, Gilbert would have faced up to life in prison for shooting Frago in the neck on Christmas Eve 2009 – Frago died from her injury several months after the shooting.
Writes the E-N’s Michelle Mondo:
“During closing arguments Tuesday, Gilbert’s defense team conceded the shooting did occur but said the intent wasn’t to kill. Gilbert’s actions were justified, they argued, because he was trying to receive stolen property: the $150 he paid Frago.”
Frago’s actions apparently constituted a “nighttime theft,” allowing Gilbert, under Texas law, to use deadly force to recover his property, his defense team argued.
What a novel idea to get away with shooting and killing someone. First, insist you paid them to fuck you. Then, explain that you killed them because they wouldn’t.
